Twitch and Amazon are facing a proposed class action lawsuit over allegations that creators' content was used to train generative artificial intelligence systems without their permission or compensation.

The lawsuit was filed on August 20, 2026, in the United States District Court for the Northern District of California by Twitch streamer Warren Pandiscia. The complaint accuses Twitch Interactive and Amazon of using streams, videos, clips, and chat content as training material for Amazon's AI products.

According to the allegations, creator content may have been collected for AI training as far back as 2024. The lawsuit claims this happened before Twitch introduced a dedicated setting allowing creators to opt out of having their channel content used for generative AI training.

Twitch introduced the AI training opt out setting on August 12. The option was enabled by default, requiring creators to manually disable it if they did not want their channel content used for training certain Amazon generative AI models.

The introduction of the setting quickly generated criticism among Twitch users. The lawsuit now raises questions about whether the new opt out system provides sufficient consent for the use of creator content and whether content that may have already been collected can be addressed through the new setting.

The complaint also alleges that Twitch changed part of its Terms of Service on the same day the AI training setting was introduced. The lawsuit argues that the change could be relevant to determining whether the company's previous terms adequately covered AI training.

Several legal claims have been brought against Twitch and Amazon, including alleged breaches of express and implied contracts, unjust enrichment, and violations of California's unfair competition law.

The case is still at an early stage, and the allegations have not been proven in court. The proposed class has also not been certified, meaning the lawsuit has not yet been formally approved to proceed as a class action on behalf of all potentially affected creators.

The dispute highlights a growing conflict between online platforms and creators over the use of user generated content for artificial intelligence development. Twitch hosts enormous amounts of video and chat content, making its platform potentially valuable as a source of training data for AI systems.

The lawsuit could therefore become an important test of how existing platform agreements apply to artificial intelligence training and whether creators must be given a more explicit choice before their work is used for that purpose.

Neither Twitch nor Amazon has publicly resolved the allegations through the lawsuit, and the legal proceedings are expected to determine whether the claims have sufficient basis to move forward.
